General Terms and Conditions of matchbus.tours

As of: October 2026

1. Provider and Scope

Operator of the platform matchbus.tours is:

Mietomnibusse GmbH
An Gut Boisdorf 1
52355 Düren
Germany

hereinafter referred to as "matchbus.tours" or "matchbus".

These General Terms and Conditions apply to the use of the matchbus.tours platform as well as to the services offered via the platform.

The platform is aimed in particular at:

  1. Users who submit a charter bus request,
  2. Bus companies that receive charter bus requests via matchbus and can get in touch with users and other bus companies on this basis ("Bus Partners"),
  3. commercial providers such as museums, theme parks, hotels, destinations, event venues, and other tourism or leisure-related providers, as well as financial service providers and suppliers who advertise via matchbus or use other offered functions ("Business Partners").

Supplementary service descriptions, prices, or special terms may apply to individual services. These will be displayed to the respective user or partner before concluding the relevant booking or order.

2. Definitions

Platform refers to the website offered under matchbus.tours, including the user accounts, backend, and communication functions provided there.

Users are natural or legal persons who submit a charter bus request via matchbus.

Charter Bus Request is a request submitted via matchbus by a user for renting a bus, including the travel and contact details provided by the user.

Bus Partners are registered bus companies that can view charter bus requests via matchbus and contact requesting users and other bus companies within the scope of the offered functions.

Business Partners are commercial providers who present or advertise their offers, destinations, facilities, events, or other tourism or leisure-related services or bus-specific services via matchbus.

Business Partnership refers to the fee-based presentation and advertising of a Business Partner via matchbus.

Additional Services are separately bookable services of matchbus, in particular the dispatch of newsletters and the unlocking of contact data for charter bus requests.

3. Role of matchbus as an Intermediary Platform

matchbus provides a digital intermediary platform through which users can submit charter bus requests and be brought into contact with Bus Partners.

matchbus does not carry out bus trips itself and does not provide transport services.

A contract for a bus trip is concluded exclusively between the requesting user and the respective Bus Partner.

matchbus is neither a bus company nor a contracting party to the transport contract concluded between the user and the Bus Partner.

The service provided by matchbus consists in particular of:

  • the technical provision of the platform,
  • the receipt of charter bus requests,
  • the transmission or provision of these requests for Bus Partners,
  • enabling contact between users and Bus Partners,
  • the presentation of Bus Partners and advertising partners,
  • the provision of additional platform and advertising services.

The user and the respective Bus Partner are solely responsible for the offer, conclusion of contract, and performance of a bus trip.

4. Charter Bus Requests

Users can submit non-binding charter bus requests via matchbus.

The user must provide the information required for the request completely and correctly to the best of their knowledge.

This may include in particular:

  • Name and contact details,
  • Departure location,
  • Destination,
  • Date and requested travel times,
  • Number of travelers,
  • Details on the planned trip, and
  • special requirements, if applicable.

The transmission of a charter bus request constitutes neither an entitlement to an offer nor an entitlement to the availability or execution of a bus trip.

The user is not obliged to accept an offer received on the basis of their charter bus request.

5. Unlocking Contact Data for Charter Bus Requests

5.1 Unlocking

Registered Bus Partners and business partners can, as far as this function is available to them, unlock the contact data of the requesting user stored for a charter bus request for a fee.

Upon unlocking, the respective partner receives access to the contact and request information available in the system at that time.

5.2 Price

Unlocking the contact data of an individual charter bus request currently costs

For Business Partners EUR 3.90 plus statutory value-added tax as applicable.

For passive Bus Partners EUR 2.90 plus statutory value-added tax as applicable.

For active Bus Partners EUR 1.90 plus statutory value-added tax as applicable.

The price displayed in the backend immediately before unlocking shall be decisive.

The remuneration becomes due upon execution of the unlocking.

5.3 No Guarantee for Accuracy and Completeness

The details of a charter bus request are generally transmitted by the respective user themselves.

matchbus does not manually check every charter bus request for accuracy, completeness, timeliness, or seriousness.

matchbus therefore assumes no liability or warranty that in particular:

  • names were provided correctly,
  • telephone numbers or email addresses are correct or reachable,
  • travel dates are complete or correct,
  • the provided travel information remains unchanged,
  • the user reacts to a contact attempt, or
  • a contract, order, or other commercial success arises from the request.

The unlocking fee is charged for the technical provision of the existing contact and request information and not for guaranteeing successful contact or business conclusion.

5.4 Timeliness of the Request upon Unlocking by Bus Partners

In particular, matchbus assumes no warranty that a charter bus request is still open at the time of unlocking by a Bus Partner.

It is in particular possible that the user in the meantime:

  • has already commissioned another Bus Partner,
  • has accepted another offer,
  • has changed or abandoned their travel plans, or
  • has no further need for offers for other reasons.

Unlocking therefore in particular does not constitute a guarantee for a still open or unassigned request.

5.5 No Exclusivity

The contact details and information of a charter bus request can be made accessible to multiple authorized partners within the framework of the platform functions offered.

Fee-based unlocking does not establish a claim to exclusivity.

5.6 Permissible Use of Contact Data by Bus Partners and Business Partners

Unlocked personal data may only be used within the framework of the purpose intended for the respective charter bus request and permissible under data protection law.

In particular, the following are impermissible:

  • Resale or address trading,
  • improper/non-purpose use,
  • disclosure to unauthorized third parties, as well as
  • any other unlawful processing.

Bus Partners and Business Partners are themselves responsible for the lawful processing of the personal data used by them after unlocking.

6. Responsibility of Bus Partners

Bus Partners act as legally independent companies and provide the bus trips offered by them under their own responsibility.

The respective Bus Partner is in particular responsible for:

  • the availability of the offered trip,
  • compliance with all statutory requirements,
  • necessary permits and concessions,
  • suitable and roadworthy vehicles,
  • adequate insurance coverage,
  • selection and deployment of driving personnel,
  • compliance with driving and resting times,
  • price and scope of services of its offer,
  • proper execution of the trip, as well as
  • modifications, cancellations, and other issues concerning the transport contract.

For the contractual relationship between user and Bus Partner, the General Terms and Conditions of the respective Bus Partner may apply additionally.

7. Business Partnerships

Business Partners can present their companies, destinations, facilities, events, offers, or other services on matchbus within the scope of a paid Business Partnership.

The specific:

  • Price,
  • scope of services,
  • start of contract,
  • contract period,
  • trial period offered, if applicable, as well as
  • cancellation and renewal conditions

result from the offer presented upon conclusion of the contract, the booking process, or an individual agreement.

The price of the regular advertising partnership is not permanently specified in these T&Cs.

The price transparently communicated to the advertising partner prior to contract conclusion shall be decisive.

Insofar as net prices are stated to entrepreneurs, these are understood to be subject to the applicable statutory value-added tax.

8. Content of Business Partners

Business Partners are responsible for the content posted by them on matchbus or provided for publication.

This applies in particular to:

  • Company information,
  • service descriptions,
  • offers,
  • prices,
  • images,
  • texts,
  • logos,
  • links,
  • opening hours, and
  • other advertising information.

Business Partners must ensure that their information is correct, current, and legally permissible.

They guarantee in particular that they hold the necessary rights to the provided texts, images, logos, and other materials and that no rights of third parties are violated.

matchbus is entitled not to publish, to block, or to remove content if there are specific indications that it is:

  • unlawful,
  • misleading,
  • technically problematic, or
  • obviously unsuitable for the platform.

9. Newsletter Dispatch for Business Partners

9.1 Scope of Services

Business Partners can book a fee-based newsletter dispatch via matchbus to the recipient group intended for this purpose within the matchbus network.

Upon successful booking, the function intended for this purpose is made available to the Business Partner in the backend.

The Business Partner can create or configure the newsletter there themselves and trigger the dispatch within the technically offered possibilities.

9.2 Price

The price for a newsletter dispatch is currently

EUR 390.00 plus statutory value-added tax as applicable for Business Partners.

EUR 90.00 plus statutory value-added tax as applicable for Bus Partners.

The price displayed immediately before completing the booking shall be decisive.

9.3 Provision and Cancellation

The newsletter service is provided in the backend after successful completion of the booking.

Since the Business Partner and the Bus Partner can access the booked newsletter function, insert content, and trigger the dispatch themselves from this point on, the booking is non-cancellable after the function has been provided.

A refund of the fee paid is generally excluded after provision.

Mandatory statutory rights remain unaffected.

9.4 Responsibility for Newsletter Content

The Business Partner and the Bus Partner are responsible for the content of the newsletter set up or provided by them.

In particular, they must ensure that:

  • information is correct and up to date,
  • no misleading or unlawful statements are included,
  • the necessary rights to texts, images, logos, and other materials exist, and
  • no rights of third parties are violated.

matchbus is entitled to block a newsletter or technically prevent dispatch if there are specific indications of legal violations, misuse, or significant security or technical problems.

9.5 Recipient Group

The newsletter will be sent to the recipients intended for this communication and technically available within the matchbus network at the time of dispatch.

The size and composition of this recipient group may change.

A specific number of reachable recipients is not owed unless explicitly agreed upon as a binding service.

9.6 No Guarantee of Success

matchbus assumes no guarantee for specific:

  • delivery rates,
  • open rates,
  • click counts,
  • inquiries,
  • leads,
  • bookings, or
  • revenues.

Stated reach or performance values represent historical or statistical information in principle and are not a guarantee of future results unless expressly agreed otherwise.

10. Further Paid Additional Services

matchbus may offer Bus Partners and Business Partners further fee-based additional services.

The type, scope, and price of the respective additional service will be displayed in the backend or in another suitable manner before the booking is concluded.

The booking of an additional service does not automatically change the term or status of an existing advertising partnership or other contractual relationship, unless expressly agreed otherwise.

11. Conclusion of Contract for Paid Services

A contract for a paid service from matchbus is concluded when a Bus Partner or Business Partner bindingly books the corresponding service via the platform or accepts an individual offer from matchbus.

Before completing an online booking, the price and essential scope of services in particular are displayed.

In the case of services provided digitally without delay, the service is deemed to have been provided as soon as the respective partner can access the booked function or information.

This applies in particular to:

  • the unlocking of contact data for a charter bus request, and
  • the provision of the booked newsletter function.

12. Payment and Stripe

Paid services of matchbus can be processed via the payment service provider Stripe.

The payment options available in individual cases are displayed during the booking process.

Unless agreed or displayed otherwise, remuneration becomes due upon conclusion of the respective paid booking.

When using a payment method offered via Stripe, the payment and transaction data required for payment processing are processed in accordance with the terms applicable thereto.

Further information on the processing of personal data in connection with Stripe is contained in the matchbus Privacy Policy.

If a payment cannot be successfully processed or authorized, matchbus is entitled not to unlock the relevant paid function or to restrict its use until payment is successful.

13. No Guarantee of Success for Intermediary and Marketing Services

Unless expressly agreed otherwise, matchbus does not owe any specific economic success for its intermediary, contact, advertising, and marketing services.

In particular, matchbus does not guarantee:

  • that offers will be received for a charter bus request,
  • that a transport contract will arise from a charter bus request,
  • that the user will react to a contact attempt,
  • that an unlocked request is still open,
  • that a Business Partner or Bus Partner will receive a booking as a result of an unlocked request, or
  • that advertising measures or newsletters will generate specific revenues, leads, or bookings.

14. Availability of the Platform

matchbus strives for reliable operation of the platform.

However, uninterrupted, error-free availability at all times cannot be guaranteed.

Temporary restrictions may arise in particular due to:

  • maintenance work,
  • technical disruptions,
  • security measures,
  • software updates,
  • failures of external hosting, communication, or payment service providers, or
  • circumstances beyond the direct control of matchbus.

Scheduled maintenance work will be carried out, as far as possible and reasonable, in such a way that disruptions are kept to a minimum.

15. Usage Rights to Partner Content

If Bus Partners or Business Partners provide matchbus with texts, images, logos, or other content, they grant matchbus the rights of use necessary for the execution of the respective contractual service.

This includes in particular the right to:

  • display the content on matchbus.tours,
  • use it in the respective partner profile,
  • use it within the scope of booked advertising services,
  • display it in booked newsletters, and
  • make technically required adjustments to formatting, size, and display.

The granted usage rights are limited to the purposes of the respective cooperation.

The partner warrants that they are authorized to grant the required usage rights.

16. Impermissible Use

The platform must not be used unlawfully or abusively.

In particular, the following are prohibited:

  • unauthorized automated extraction of data,
  • circumvention of technical protection or payment barriers,
  • resale of unlocked contact data,
  • unauthorized disclosure of personal data,
  • non-purpose mass contact,
  • posting unlawful content, as well as
  • actions that could impair the security or functionality of the platform.

In the event of significant or repeated violations, matchbus may temporarily or permanently restrict or block access to the platform.

17. Liability and Distinction from the Execution of Bus Trips

17.1 No Liability for the Execution of the Bus Trip

matchbus is exclusively the operator of an intermediary platform and does not carry out bus trips itself

The contracting party for the execution of an arranged bus trip is exclusively the respective Bus Partner.

matchbus is therefore not liable for the fulfillment of the transport contract concluded between the user and the Bus Partner and in particular not for:

  • cancellation of a trip,
  • delays or premature termination of a trip,
  • condition or equipment of a vehicle,
  • availability of an agreed vehicle,
  • behavior or deployment of the driving personnel,
  • route guidance and travel times,
  • compliance with driving and resting times by the Bus Partner,
  • prices agreed by the Bus Partner,
  • scope of services of the Bus Partner, or
  • other breaches of duty in the execution of a bus trip.

Claims arising from the transport contract must be asserted against the respective Bus Partner.

17.2 Liability of matchbus for Its Own Services

For matchbus's own breaches of duty, the following provisions apply:

matchbus is liable without limitation:

  1. in case of intent and gross negligence,
  2. in case of culpable injury to life, body, or health,
  3. under mandatory statutory liability provisions, and
  4. insofar as matchbus has expressly assumed a guarantee.

In the event of a slightly negligent breach of an essential contractual duty, matchbus's liability is limited to the damage typical for the contract and foreseeable at the time of contract conclusion.

Essential contractual duties are duties whose fulfillment makes the proper execution of the service owed by matchbus itself possible in the first place and on whose compliance the contractual partner may regularly rely.

Otherwise, liability for slight negligence is excluded to the extent permitted by law.

The foregoing limitations of liability apply accordingly in favor of the legal representatives, employees, and vicarious agents of matchbus.

18. Third-Party Data and Information

Insofar as information and content originate from users, Bus Partners, or Business Partners, the respective party is in principle responsible for its accuracy, completeness, and legality.

matchbus is generally not obliged to fully check all information posted by third parties prior to its provision.

This applies in particular to:

  • Information in charter bus requests,
  • company information,
  • prices,
  • images and other partner content.

Upon becoming aware of obviously illegal or incorrect content, matchbus may block, correct, or remove it insofar as this is necessary and permissible.

19. Data Protection

The processing of personal data is governed by the currently valid Privacy Policy of matchbus.tours.

This applies in particular to data processing in connection with:

  • charter bus requests,
  • transmission and unlocking of contact data,
  • user and partner accounts,
  • communication between the parties involved,
  • newsletter functions,
  • reach and usage statistics, as well as
  • payment processing via Stripe.

Bus Partners and Business Partners are obliged to use personal data made available to them via matchbus exclusively within the legally permissible scope and for the intended purpose.

20. Blocking and Termination of Partner Accounts

matchbus is entitled to temporarily or permanently block a partner account if there are specific indications of a material breach of these T&Cs or applicable law.

This may in particular be the case with:

  • misuse of unlocked contact data,
  • resale or unauthorized disclosure of data,
  • unlawful content,
  • manipulation of platform functions,
  • circumvention of payment barriers,
  • significant payment arrears, or
  • other material abusive use.

As far as possible and reasonable, the affected partner will be given the opportunity to comment or remedy prior to a permanent block.

The right to extraordinary termination for good cause remains unaffected.

21. Term and Termination of Continuing Obligations

Terms, notice periods, and extensions, if any, of advertising partnerships or other permanently agreed services result from the conditions agreed upon conclusion of the contract.

Mandatory legal provisions remain unaffected.

22. Amendments to these T&Cs

matchbus may amend these T&Cs for future contracts.

In the case of existing continuing obligations, changes may be made if there is an objective reason for doing so and the change does not unreasonably disadvantage the contractual partner.

This may include in particular:

  • Changes in statutory requirements,
  • changes to platform functions,
  • technical further developments, or
  • adjustments to the range of services.

Material changes will be communicated to affected contractual partners in a suitable manner.

23. Applicable Law and Jurisdiction

For contracts with entrepreneurs, the law of the Federal Republic of Germany applies to the exclusion of the UN Sales Convention (CISG), insofar as permitted by law.

If the contracting party is a merchant, a legal entity under public law, or a special fund under public law, Düren shall be the place of jurisdiction, insofar as legally permissible.

For consumers, the mandatory statutory provisions regarding applicable law and place of jurisdiction apply.

24. Contract Language

The contract language is German.

If translations of these T&Cs are provided, they serve informational purposes.

In the event of discrepancies between a translation and the German version, the German version shall prevail as far as legally permissible.

25. Final Provisions

Should individual provisions of these T&Cs be or become invalid in whole or in part, the remaining provisions shall remain unaffected.

In place of the invalid provision, the statutory provisions shall apply.
